who’s who
this agreement is between you — the brand, artist, or agency buying a sound promo (“you”) — and 0xdesigner LLC, operating as guywithapple (“i”, “me”). it becomes binding when you complete payment through your pay link.
what you’re buying
placement of your sound in videos posted to the @guywithapple tiktok account:
- one post — one video with your sound.
- one week — at least 3 posts a day for 7 consecutive days.
- one month — at least 3 posts a day for 30 consecutive days.
the first post goes live within 7 days of payment. week and month packages run on consecutive days once they start.
creative control
the videos are mine: concept, format, timing, and execution. you’re buying placement, not a script, and there’s no approval step. i can pass on any sound before accepting an offer — that’s what the review is for.
disclosure
posts may carry advertising disclosures — #ad, branded-content labels, or other platform-required tags. that’s required by law and platform policy and isn’t negotiable.
no guarantees
view counts, engagement, and outcomes aren’t guaranteed. the numbers on the site are real historical stats, not promises, and performance is never grounds for a refund.
refunds
if i can’t deliver the package as described, you get the undelivered portion back — the whole amount if nothing was posted, a pro-rata share if a multi-post package was partially delivered. refunds go back to the original payment method.
your sound, your rights
you promise you own or control every right needed for me to use the sound on tiktok — the recording and the underlying composition — and that nothing in it is unlawful. if someone claims otherwise, that’s on you: you’ll defend and indemnify me against claims, damages, and costs arising from the sound or materials you provide.
the videos
the videos are my property and live on my feed. posts stay up permanently, with two exceptions: a takedown caused by rights problems with your sound (no refund), or platform action outside my control. if a post comes down for a reason within my control, i’ll replace it. you don’t get rights to repost, download, edit, or run ads with the videos — spark ads and licensing are separate written deals.
liability
my total liability under this agreement is capped at the amount you paid. neither of us is liable for indirect or consequential damages.
payment
payments are processed by stripe. your card statement will show a descriptor that includes GUYWAPPLE. taxes, where applicable, are your responsibility.
the rest
this is the entire agreement for the promo. it’s governed by the laws of the state where 0xdesigner LLC is organized. if any part is unenforceable, the rest stands. the version of these terms shown at checkout when you pay is the one that applies.
